All credit/debit cards details and personally identifiable information will not be stored, sold, shared, rented or leased to any third parties. Electromin – Volvo KSA may elect to use broker offices for the registration of the vehicle.
- Saudi Arabia is our country of domicile
- Website will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of Saudi Arabia.
- We accept payments online using Visa and MasterCard credit/debit card up to SAR 50,000. Refunds will be done only through the original mode of payment
- Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of Saudi Arabia.
1. Definitions
- “Customer”: means the buyer of certain Volvo cars.
- “Electromin - Volvo KSA “: means the seller of Volvo cars.
- “Purchase Agreement”: means purchase of a car and a reference to this document.
- “Third Party”: means any other party who picks up or registers the car on behalf of the Customer.
- “Terms & Conditions”: means the terms and conditions set forth herein.
- “Car”: means the car purchased by the Customer from Electromin - Volvo KSA as set out in the Purchase Agreement.
2. Validity of the Agreement / Transfer of Ownership / Buyers Obligations
- The Purchase Agreement shall enter into force immediately upon the signature thereof by Electromin - Volvo KSA and the Customer and upon providing the full purchase price. The Customer hereby confirms and acknowledges that it had the opportunity to review and is fully aware of the contents of the Purchase Agreement and the Conditions of Use.
- No alterations to the Car specifications may be requested by the Customer after the signature of the Purchase Agreement and the receipt of the full purchase price by Electromin - Volvo KSA.
- By signing the Purchase Agreement, the Customer acknowledges that it considered the purchase of the Car and agreed to buy the car with the vehicle identification number (VIN) shown along with all the specifications including, but not limited to, the interior color, exterior color, model, specifications, and the conditions of the car.
- Electromin - Volvo KSA represents and warrants that the Car is in compliance with the standards and specifications applicable in the Kingdom of Saudi Arabia and in conformance with the import, customs, and licensing regulations at the time of purchasing the car.
- Electromin - Volvo KSA represents and warrants that the Car is exclusively owned and possessed by Electromin - Volvo KSA and is totally unencumbered and free of any outstanding amounts or customs duties. Further, Electromin - Volvo KSA confirms that the car is not the subject of any dispute, procedure or other court orders including attachment, confiscation or protective custody, nor sale and/or ownership transfer restrictions.
- The Customer shall have no right to terminate or void the Purchase Agreement in case of any adjustments in the production, change in the design and/or difference in the color of the car which could occur between the commencement date of the Agreement and the delivery date, provided that such adjustments and modifications are minor.
3. Termination Terms
- The Customer may, before transferring the ownership of or registering and/or obtaining the license plate of the Car at the Traffic Department, terminate the Purchase Agreement in case of breach by Electromin - Volvo KSA of its obligations under this Agreement. For avoidance of doubt, the Customer may not terminate the Purchase Agreement once the Car is registered, its license plate is issued and/or its ownership is transferred.
- If the Purchase Agreement is terminated for any reason other than the fault of the Customer, where Electromin - Volvo KSA is directly at fault due to willful misconduct or negligence. Electromin - Volvo KSA shall be obliged to refund any amounts already paid by the Customer.© A 10% cancellation fee will be charged to the Customer if he/she terminates the Purchase Agreement prior to transferring ownership of the Car. Electromin - Volvo KSA shall have the right to deduct such amount from any amounts already paid by the Client.
- In the event that a customized or modified Car is ordered, the Customer’s down payment shall be nonrefundable regardless of the payment method.
- The Customer may not terminate the Purchase Agreement after the ownership of the Car is transferred in his/her name. The Car will be treated as a used vehicle as soon as ownership is transferred to the Customer.
- If the Customer, wishes to terminate this Purchase Agreement before the transfer of ownership and registration of the Car, the Customer must set out the reasons for such termination in the prescribed redemption form and sign and submit the same to Electromin - Volvo KSA ’ representative. The refund process for transferring the amounts to a bank designated by the Customer shall take place within fifteen (15) business days.
Note: Refunds for online sale will be by wire transfer only. No refunds will be made in cash or by check.
4. Calculation of Invoice Price
- As set forth in the Purchase Agreement, the total invoice amount to be paid by the Customer must include all the invoice components such as the transaction fee, management fee, value added tax and/or any other paid government fees or charges.
5. Price and Payment Method
- Electromin - Volvo KSA will approve the Purchase Agreement after the Customer’s acceptance of the purchase offer. The confirmation of acceptance, copy of payment receipt and Car delivery date confirmation will be forwarded to the Customer after the amount is paid in full. (In the event that the delivery date is changed due to late payment, Electromin - Volvo KSA may reschedule the Car delivery date after notifying the Customer by email and change the Purchase Agreement to reflect the new delivery date. An original stamped and signed counterpart of the amended Agreement will be forwarded to the Customer).
- The Purchase Agreement entered into by and between both parties shall specify the final price to be paid by the Customer for the Car.
- Upon the execution of the Purchase Agreement, the Customer shall pay the final price to Electromin - Volvo KSA in the manner indicated in the Purchase Agreement whether by check or wire transfer, in accordance with government regulations.
- The value added tax will be applied, in accordance with the regulations prescribed by the government, to all invoices issued by Electromin - Volvo KSA. The Customer will be liable for the payment of VAT.
6. Delivery and Delayed Delivery of the Car
- Customer must properly identify themselves in a manner acceptable to Electromin - Volvo KSA before receiving the Car. If the Customer fails to provide adequate documents to identify themselves as the purchaser of the Car, Electromin - Volvo KSA shall reserve the right to hold back the delivery of the Car.
- The Customer shall be responsible for conducting a full inspection of the interior and exterior of the Car at the time of receipt. Further, the Customer shall sign the acknowledgement of receipt when he / she receives the Car at the showroom, service center or another agreed location. By signing the acknowledgement receipt, the Customer or any Third Party delegated by the Customer acknowledges that he / she:
- Conducted a full inspection of the Car prior to receiving the Car;
- Received the Car in perfect condition and free of any material defects;
- Received all the accessories of the Car including, but not limited to, the keys, brochure, operation manual and warranty information.
- The Customer waives and releases Electromin - Volvo KSA of any responsibility and any claim against it in respect of any damage to the Car reported after the signature of this form. Unless a delivery time and date is scheduled and informed to the Customer in writing, the date and time of delivery specified by Electromin - Volvo KSA is purely discretionary and is subject to change at the discretion of Electromin - Volvo KSA.
- Electromin - Volvo KSA shall make all reasonable efforts to deliver the Car on the date it notified the Customer of in writing, taking into account any force majeure or unforeseen circumstance that may arise that prevents the delivery of the Car.
- The place of delivery shall be Volvo KSA showroom and/or pickup center, unless agreed otherwise in writing by Electromin - Volvo KSA and the Customer.
- Electromin - Volvo KSA shall, at the request and the authorization of the Customer and on the responsibility of the Customer for any risks, transfer the Car to another place other than the Electromin - Volvo KSA delivery locations. The mode of transportation shall be determined by Electromin - Volvo KSA only, by either a public or private transportation company, and Electromin - Volvo KSA will obtain insurance to cover the transport and delivery of the Car. The Customer shall release Electromin - Volvo KSA completely of any responsibility and waive any obligation or claim for any damage to the Car during delivery to any place other than Electromin - Volvo KSA delivery locations. The Customer shall not be entitled to any compensation for any milage and damages as a result of such delivery.
- In the event of a delay in delivering the Car exceeding seven (7) days beyond the agreed delivery date the Customer shall have the right to request a compensation of SAR 400 per day until the delivery of the vehicle is performed.
- In the event that the Customer requests delivery of the Car in a city where Electromin - Volvo KSA does not have a branch, the Customer shall bear the transportation cost, including the transportation insurance coverage.
- The Customer must collect the Car on the delivery date agreed in writing. If the Customer requests an extension or a delay in delivery, he / she should send a signed written letter, email or other written method of communication to Electromin - Volvo KSA asking for a new delivery date. Unless agreed otherwise in writing by Electromin - Volvo KSA, if the requested extension or delay is more than ten (10) business days beyond the original delivery date, Electromin - Volvo KSA will charge the Customer SR 240 per day for demurrage until the Car is handed over to the Customer.
- If the Customer fails to take possession of the Car at the agreed date (or any other extended date) and / or fails to ask for a new extension, the Customer will be charged SR 240 per day for demurrage to be paid to Electromin - Volvo KSA before the delivery of the Car. Electromin - Volvo KSA will by no means be held responsible for any damages caused to the Car while in storage.
- For avoidance of doubt, Electromin - Volvo KSA will not be responsible for any reported damages after the Customer signs the delivery note.
7. Retaining / Transfer of Ownership
- The Customer, any Third Party, or his/her legal representative (by virtue of a duly given power of attorney) must provide sufficient evidence to identity themselves to pick up the car.
- The Customer shall take the responsibility for providing Electromin - Volvo KSA with any original documents that it may request to confirm the identity of the Third Party to whom the ownership is to be transferred as well as any other documents affirming the representation and confirming the acceptance of the Third Party to whom the ownership is to be transferred in the event that the Third Party is the owner of the Car.
- In the event that ownership of the Car cannot be transferred for any reason (other than the fault of Electromin - Volvo KSA), Electromin - Volvo KSA may terminate the Purchase Agreement and reimburse the amounts paid by the Customer as per the refund policy established by Electromin - Volvo KSA.
- The Car will remain the property of Electromin - Volvo KSA until all amounts payable to Electromin - Volvo KSA in relation to the Car are paid by the Customer and the ownership is transferred to the customer.
- By signing the Purchase Agreement, the Customer acknowledges and confirms he / she conducted a full inspection of the Car & agrees to buy the Car.
8. Defects Liability and Quality Assurance
- Volvo cars have a three year global manufacturer’s warranty with unlimited mileage according to Volvo standards and technical specifications. The warranty covers any defects in the quality of the vehicle according to the terms and conditions of the manufacturer as set forth in the warranty booklet. The vehicle high voltage battery is covered by 8 Years or 160,000 KM whichever comes first. The validity period of the manufacturer’s warranty starts from the date of registration of the Car.
- The repair of the Car or replacement of defective parts shall be performed in accordance with the obligations set forth in the warranty and the technical requirements. The replaced parts shall remain the property of Electromin - Volvo KSA.
- The warranty shall be void if the Customer fails to comply with the instructions for use and maintenance of the Car as set forth in the warranty booklet and the Car’s maintenance manual.
- In all cases, the warranty shall not apply if the defect was a result of misuse or after the expiration of the warranty period.
9. Liability for Damage
- The maximum liability of Electromin - Volvo KSA is limited under the Purchase Agreement to the import, sale, and delivery of the Car to the Customer, and any issues relating to the warranty, and shall be limited to the costs of repair by Electromin - Volvo KSA ’ after-sale team in accordance with the manufacturer’s instructions.
- Electromin - Volvo KSA shall keep all logs for any repairs of damage done to the Car.
- Electromin - Volvo KSA shall notify the Customer of any repair of damages made to the Car and obtain his approval of such repairs.
- In case the Car was not repaired and accepted by the Customer “as is”, the Customer shall sign a form and any other document, including photographs of the damage, to waive the repairs and accept receipt of the damaged Car.
- Electromin - Volvo KSA shall not be held responsible for any damages reported after the Customer signs the delivery notice upon the physical receipt and possession of the Car.
10. Online Sales / Off-Site Sales
- In the event the Purchase Agreement is concluded without a physical meeting between Electromin - Volvo KSA’ representative and the Customer, the following criteria must be met to confirm the agreement:
- The Purchase Agreement shall be executed by the Customer and Electromin - Volvo KSA ’ representative by email or any other digital channel.
- An email shall be sent by Electromin - Volvo KSA ’ representative to the Customer to confirm acceptance of this agreement within 48 hours from the date of the Customer receiving the Purchase Agreement.
- Once the Agreement is approved by Electromin - Volvo KSA, the Customer may not amend or change the Agreement without Electromin - Volvo KSA ’ written approval.
- Prepayment or advance booking is not available for online sales / off-site sales.
11. Final Terms
- The terms and conditions set forth in the Purchase Agreement are applicable only to the sales of new Volvo cars to customers resident in Saudi Arabia.
- Any amendments to the Purchase Agreement shall be invalid, unless confirmed and accepted in writing by Electromin - Volvo KSA within a maximum of 48 hours.
- The purchase order, as confirmed, shall constitute the entire agreement between Electromin - Volvo KSA and the Customer in respect of the sale and purchase of the Car. Any annexes and / or amendments to the Purchase Agreement shall be made in writing and signed by both parties. Electromin - Volvo KSA shall not be responsible for any expenses incurred by the Customer in connection with the purchase of the Car including, but not limited to, any travel costs, costs of moving to the delivery location, accommodation costs, telephone charges, penalties, cancellation fees or any other expenses whatsoever.
- Additional directions and instructions are available on the owner’s manual.
- The terms and conditions of this Purchase Agreement shall take precedence over and supersede any and all previous oral or written negotiations, discussions, communications, understandings and / or agreements between Electromin - Volvo KSA and the Customer.
- If the Customer files any legal action against Electromin - Volvo KSA, its affiliates or employees before any government bodies including, but not limited to, Saudi courts in regard to the Purchase Agreement, purchase order and / or the terms and conditions and he/she does not succeed in the claim, the Customer shall be liable to pay to Electromin - Volvo KSA all the legal expenses and attorney’s fees it incurred in defending such claim.
12. Reservations
- Electromin - Volvo KSA may reserve the Car for the Customer for five (5) days for cash payments and up to ten (10) days for financial lease if the Customer provides a refundable advance payment in the amount of SR 10,000 inclusive of VAT.
- Electromin - Volvo KSA may cancel the reservation if the Customer fails to pay the purchase price or complete the purchase order within the reservation period, and may sell the Car to another customer.
- The Customer has the right to request a refund of due amount, if any, subject to a written communication from Electromin - Volvo KSA indicating expiration of the reservation period.
13. Transit and Tailored Cars Reservations
- Transit cars can be reserved according to the same reservation policy provided for herein. However, the reservation period shall commence as of the date of Electromin - Volvo KSA ’ written notice to the Customer reporting the arrival of the Car at Electromin - Volvo KSA ’ premises.
- Customized Cars will be ordered from the manufacturer only when Electromin - Volvo KSA receives an advance payment of 25% of the Car’s value and a completed and signed “Customized Vehicle Purchase Order form” from Electromin - Volvo KSA.
